How to Win the War against our Constitution

Two hundred and fifty years ago, our founders started a new nation, dedicated to the proposition that all of us are created equal… And that we are endowed with certain inalienable rights. And that among these rights are the right to life, liberty and the pursuit of happiness.

Today, we are engaged in an Information War, a war against our inalienable right as parents to guide the upbringing of our children – a right as precious as our right to life, liberty and happiness. This war against parents, which has already harmed hundreds of thousands of families and destroyed the future of nearly one million children in the US, has exposed an even deeper war, which is our inalienable right as parents to petition the government for redress of grievances. During the past year, we, the thousands of members of the Washington Parents Network, have filed numerous complaints with the US Department of Justice, over the grotesque violation of several Constitutional Civil Rights and numerous federal civil rights laws.

The Judiciary Act, passed by our First Congress in 1789, provides that each federal district shall have one US Attorney, to enforce federal laws and protect our Constitutional rights. It is the responsibility of these US Attorneys to investigate our petitions for redress and take the steps needed to restore our inalienable civil rights. There are currently 93 federal districts in the US, with two of these federal districts located in Washington state. In 2025, for the first time in US history, the illegal Senate Blue Slip process was used to block the appointment of 40 US Attorneys out of 44 federal districts represented by Senators from the Democratic Party.

In Washington state, Senator Patty Murray has illegally blocked the US Attorney for Eastern Washington, Pete Serrano and the US Attorney for Western Washington, Neil Floyd. This has deprived parents in Washington state of our right to petition the government for redress of grievances, a clear violation of the First Amendment.

Therefore, in January, 2026, we filed a 99 page complaint with the US Department of Justice, demanding that they seek a ruling from the Supreme Court declaring the Senate Blue Slip policy to be unconstitutional. You can read our Blue Slip complaint at this LINK. Unfortunately, the Department of Justice has chosen a different path. Instead of forcing the Senate to vote on these US Attorneys, they have declared the 40 blocked US Attorneys to be “Special” Attorneys. Sadly, such “special” US Attorneys are not provided for either in the US Constitution or by any federal law. As a consequence, at least 7 federal courts have ruled against the Department of Justice in the past six months. While these legal battles are still ongoing, it is unlikely that the Supreme Court will rule in favor of the “special” Attorney trick being used to evade the US Constitution.

One of many Constitutional problems, Article II, Section 2 of the US Constitution states that federal officers, including all US Attorneys, SHALL be nominated by the President and SHALL be confirmed with the “Advice and Consent” of the Senate. The word SHALL means that the appointment of US Attorneys is a mandatory duty of both the President and the Senate. The Senate can vote to not approve the nominee but they are not allowed to to use an unwritten and illegal Blue Slip policy of a single Senator to refuse to even consider the nominee. Thus, the failure to provide the People with US Attorneys is a Constitutional violation of the Senate – including the Republican Senators who are currently in charge of the Senate. In short, there is not only a war against parents, but there is also a war against the US Constitution. Currently, in 2026, more than one hundred million Americans are being deprived of our Constitutional right to a US Attorney by the illegal Senate Blue Slip policy.

How can we win the war being waged against our Constitution - and restore our inalienable rights?

The greatest weapon we have to win the War being waged against our Constitution is to learn the Truth and tell the Truth. As it says in the Bible, “We will learn the Truth and the Truth will set us free.”

So how do we discover the Truth about our Constitution? During my research into the Constitution, I first came across James Madison’s 1787 Notes of the Constitutional Convention. I included quotes from Madison in our Blue Slip complaint. I then came across the Federalist Papers written in 1788 by Madison, Hamilton and Jay during the Ratification Conventions – and I included quotes from the Federalist Papers in our Blue Slip complaint. Finally, I came across a 900 page book written by Joseph Story in 1833, called Commentaries on the Constitution. Joseph Story was appointed to the US Supreme Court by James Madison in 1811 and served on the US Supreme Court for over 30 years where he was a close friend of Chief Justice John Marshall. Story also started the Harvard Law School in 1829. His book included dozens of quotes from Madison and hundreds of quotes from the Federalist papers. It also included thousands of quotes from more than 300 other authorities, including several landmark Supreme Court rulings, explaining both the history and meaning of every section of the US Constitution.Thus, Commentaries on the Constitution was by far one of the most important books ever written about the US Constitution.

Story’s father, Elisha, was a member of the Sons of Liberty and participated in the Boston Tea Party. Elisha also fought at the battles of Lexington, Concord and Bunker Hill. Joseph Story put so much effort into writing his book on the US Constitution because he feared that the failure to understand the Constitution might lead to a Civil War and he hoped that a better understanding of the Constitution might prevent this war. While he failed to stop the Civil War, his explanation of “American Republicanism” led to the founding of the Republican Party and greatly influenced Abraham Lincoln on the importance of preserving the Union. In fact, Lincoln’s most famous line, “a government of the People by the People and for the People” came from Joseph Story, who stated in Commentaries Book 3, Chapter 5, Paragraph 397 that the government created by the US Constitution was a government “made by the People, made for the People and is responsible to the People.”

There was only one problem with Joseph Story’s Commentaries on the Constitution. The only available digital versions of the book, while free and open source, contained thousands of spelling and formatting errors. For example, the word favor used an older spelling of “favour”. I spent several days using a spell checker to fix these errors. The book was still largely unreadable because Story was fond of using extremely complex sentences with lots of conjunctions. So I broke up these complex sentences into simpler and shorter sentences. Story also used several words that are no longer in common use. I replaced these with modern synonyms. Story also used a lot of Latin phases – many of which I translated into English. Story also included page after page of legal history often going all the way back to Greece and Roman times. Some of these I left, but many I deleted as being irrelevant to the historical interpretation of the US Constitution. Finally, the book included numerous formatting errors that made reading difficult. I corrected these formatting errors, which while making the book much more readable, also increased the number of pages to 1270. In addition, Story also wrote an Abridged version of his Commentaries, reduced to only 250 pages, which he published in 1840. I have therefore also created a readable version of this shorter book which is also available for free at the same LINK. It is intended for people who do not have the time to read the entire 900 page book and it also includes the same 7 documents in the Appendix .

What difference would it make if more citizens read one of Joseph Story’s books and became aware of the true meaning of the US Constitution?

Right now, our Constitution is lying in the mud. During the past year, the leaders of both political parties, for reasons of their own, chose to violate their Oath of Office and ignore the plain meaning of Article II, Section 2 of the US Constitution which states that the President SHALL NOMINATE and the Senate SHALL PROVIDE ADVICE and CONSENT of ALL OFFICERS – including US ATTORNEYS for each and every federal district. This year, due to the unconstitutional Senate Blue Slip policy, the President has not nominated and the Senate has not provided Advice and Consent on US Attorneys for 40 of of 93 federal districts. As a consequence, due to the illegal Senate Blue Slip policy, for the first time in our Nation’s history, 40 of 93 federal districts do not have a valid, Senate-confirmed US Attorney. Lacking a valid US Attorney, more than one hundred million citizens in our Nation have lost their Constitutional and Inalienable Right to Petition the Government for Redress of Grievances.

If more people read one of Story’s books, they would not only learn more about our Constitution, they would learn that it is up to We, the People, to preserve, protect and defend our Constitution. They would learn that it is up to each of us to demand that our elected leaders comply with the Constitution. They would learn that the US Constitution is more important than either political party. They would learn that We, the People, need to make the preserving, protecting and defending the US Constitution the most important issue of this years election and every years election.

There are 33 Senators running for election this year and 34 more Senators running for election in 2028. We need to demand that these Senate pledge to end the Senate Blue Slip policy – and if they refuse, we need to replace them with someone who will pledge to end the Senate Blue Slip policy.

Among the Senators running for re-election in 2028 is Washington Senator Patty Murray who has publicly used the Senate Blue Slip policy to illegally block the Article II, Section 2 Confirmation process for US Senators in both Western and Eastern Washington. Our hope is that members of the Washington State Republican Party will pass a resolution demanding an end to the unconstitutional Senate Blue Slip policy and that they will also demand that all Republican Candidates for the US Senate pledge to end the illegal Senate Blue Slip policy. The US Constitution is the foundation of all of our Rights. If our Constitutional Republic is to endure, if we want to restore Parental Rights or any other Inalienable Rights, then we must ALL make Preserving, Protecting and Defending our precious Constitution our highest priority.
